1. Introduction

These Gift Card Terms & Conditions govern the purchase, use, and redemption of electronic and physical Gift Cards ("Gift Cards") issued by American-Creator.com ("Company", "we", "us", "our") through our website at american-creator.com ("Site"). By purchasing or using a Gift Card, you agree to be bound by these Terms, along with our general Terms of Service and Privacy Policy.

2. Purchase and Delivery

• Availability: Gift Cards can be purchased on our EU Online Store and are denominated in Euros (€ / EUR).

• Delivery: Digital Gift Cards are delivered to the recipient via the email address provided at checkout.

• Accuracy: The Company is not responsible for non-delivery due to incorrect contact details provided by the buyer.

• No Fees: No activation fees, service fees, dormancy fees, or management fees apply to any Gift Cards.

 

3. Right of Withdrawal (14-Day Cooling-Off Period)

• Statutory Right: If you purchase a Gift Card online as a consumer within the European Union, you have the right to withdraw from the contract within 14 calendar days from the day of purchase without giving any reason.

• Exceptions: This right of withdrawal expires immediately if the Gift Card code is fully or partially redeemed before the 14-day period ends.

• Exercise: To exercise your right to withdraw, you must inform our support team via a clear statement before the 14 days expire.

 

4. Redemption and Balance

• Usage: Gift Cards can only be redeemed for eligible nail products, base gels, extension gels, and professional equipment available on the Site.

• Store Restrictions: Gift Cards purchased on the EU Online Store can only be used for purchases on the EU storefront and cannot be transferred to other regional subdomains.

• Partial Use: If a purchase does not use the full value of the Gift Card, the remaining balance will be saved for future purchases.

• Non-Cash Redeemable: Gift Cards cannot be resold, transferred for value, or redeemed for cash, except where required by applicable local EU laws.

 

5. Validity and Expiration

• Validity Period: In accordance with general European civil law standards, Gift Cards issued for EU customers are valid for a period of three (3) years.

• Start Date: This period begins on December 31st of the year in which the Gift Card was purchased.

• Expiry: Any remaining balance after this period expires will be forfeited and cannot be refunded or reinstated.

 

6. Returns and Refunds

• Returned Orders: If you return an item purchased using a Gift Card, the refund will be credited back to the original Gift Card or issued as store credit, subject to our standard Return Policy.

• Refund Split: If you used a combination of a Gift Card and another payment method, the refund will be split proportionally.

 

7. Lost, Stolen, or Damaged Cards

• Card Security: Treat your Gift Card code like cash.

• No Liability: The Company is not responsible if a Gift Card code is lost, stolen, destroyed, or used without authorization.

• Replacement Policy: Replacement codes will only be issued if the customer provides proof of purchase and the full original code can be verified as completely unused in our database.

 

8. Data Protection (GDPR)

• Compliance: Any personal data provided in connection with the purchase or use of Gift Cards will be processed in accordance with the General Data Protection Regulation (GDPR) and our Privacy Policy.

 

9. Governing Law and Dispute Resolution
